PUC Water Rate Appeal Update

In October 2015, residents of the Trophy Club Municipal Utility District No. 1 (TC MUD) filed an appeal of the water and sewer rates set by the MUD Board with the Public Utility Commission of Texas (PUC), and the Trophy Club Public Improvement District (PID) residents petitioned to be a party to that appeal. Subsequently, the PUC denied the PID residents the right to join in the appeal filed by the MUD residents. The parties are currently at the stage where they are negotiating an agreed procedural schedule for the appeal, and each party will begin requesting and gathering information for its respective position in the appeal. Since the PUC denial, the Town has been asked whether it can file an appeal in support of the MUD residents and in support of the PID residents efforts to be added as a party to the PUC proceeding; specifically, the Town has been requested to submit a brief supporting the appeal.

In response to the inquiry, the Town has researched to determine what, if any, steps or involvement are available to the Town. Unlike standard litigation processes, in a PUC proceeding, there is no option for the submission of a brief in support of any party to the proceeding. The PUC will only receive evidence and testimony from the actual parties to the case. The Town has been advised by its Utility and Special District Legal Counsel that there is no action available for the Town to take in the pending proceeding.
