Trophy Club Town Center Property Owner Requests Amendment to PD-30

UPDATE (March 7, 2014) --- The Town Council held a Public Hearing on Monday, March 3, 2014 and discussed the PD-30 development standards amendment request from the Trophy Club Town Center developer. Six residents addressed Council with various questions, concerns and suggestions. The two main issues discussed were the townhomes and the retail-ready component of the proposed amendment. After a lengthy discussion and negotiations, the Town Council voted to approve the PD-30 development standards amendments by a vote of 5-1.

COUNCIL ACTION: Motion to approve the amended ordinance for PD-30, with amendments to exhibit B as recommended by P&Z with several changes. Motion passed 5-1 with Council Member Greg Lamont voting against.

The following changes represent the significant amendments to the PD-30 development standards:

  • Allow 33 additional multifamily units (minimum of 1200 sq ft) as retail-ready ground floor units in buildings B4, B5 and B7, where the developer has two years to market bottom floors as retail/commercial/office before the option to convert to multifamily is available.
  • Must have Certificate of Occupancy (CO) for 50% of retail before the CO for apartments is issued.
  • Non-residential and non-parking buildings must have a minimum of 30% and a maximum of 40% glass on ground floor façade.
  • Townhome design standards tightened with minimum one-car garage (10’x18’ minimum) and one guest parking space per townhome. Townhome lot and primary residential entry must front public streets with a minimum setback of 10’. Separate Property Owners Association (POA) for townhomes.
  • Hail protected EIFS use limited to non-residential buildings, second story or above, as aesthetically appropriate.
  • Balconies not allowed on facades facing Trophy Club Drive.
  • Roof top equipment screening required.
  • Allow public service/public safety facilities.
  • Buildings A & B must be simultaneously constructed.

UPDATE (February 21, 2014) --- The Planning & Zoning Commission held a Public Hearing and heard the PD-30 resubmitted proposed amendments last night, and after much debate and negotiating, approved a recommendation to Council for the proposed amendments by a vote of 4-3. The Town Council will conduct a Public Hearing on Monday, March 3, 2014 at 7:00 p.m. in the Svore Municipal Building Boardroom.

The following outlines the motion from the meeting; however, the official redline of the motion will be included in the March 3, 2014 Town Council agenda packet and will include the official proposed language for Council consideration:

  1. 33 apartments allowed on the ground floor of buildings B4, B5 and B7, for a total of 283 apartments allowed in PD-30.  The ground floor units shall be made retail-ready and shall be marketed as retail for a period of two (2) years; the two (2) year timeframe to commence at time of building permit issuance. 
  2. The 33 ground floor apartments shall be a minimum of 1,200 sq. ft.
  3. Townhomes design standards:  7. F) i. and ii. Combine to state that a minimum of 85% of the front, side and rear façade of Townhome Residential shall be finished in masonry (brick, stone, cast stone, or glass block). Keep (and re-number as appropriate) 7. F) iii. EIFS allowed at or above the second floor for decorative trim, moldings, etc.
  4. Parking Garage – no exposed concrete facing SH 114; shall meet architectural standards of adjacent hotel or office.
  5. Separate Property Owner Association (POA) for Townhomes.
  6. Remove public facilities, municipal facilities and public safety facilities as permitted uses.
  7. Phasing:  Area A and B shall be simultaneously constructed (wording detail under review).

UPDATE (February 6, 2014) --- Due to rapidly deteriorating road conditions in and around Trophy Club, the Planning and Zoning Commission (P&Z) meeting scheduled for Thursday, February 6, 2014 has been cancelled. The next P&Z meeting is scheduled for Thursday, February 20, 2014.  All items on this evening’s agenda will be heard on February 20, 2014, including the Public Hearing scheduled for PD-30. The PD-30 public hearing will be republished in the newspaper and property owners within 200-ft. will be notified of the new date


UPDATE (January 27, 2014) --- After considering the feedback from the January 16, 2014 Planning & Zoning Commission Public Hearing and Regular Session, the PD-30 Developer has resubmitted proposed amendments to the PD-30 Development Standards. Another Planning & Zoning Commission Public Hearing is scheduled for Thursday, February 6, 2014 at 7:00 p.m. in the Svore Municipal Building Boardroom (100 Municipal Drive).

UPDATE (January 17, 2014) --- The Planning & Zoning Commission heard several resident concerns, asked questions of the developer's team and considered the proposed amendments submitted by the PD-30 developer. Ultimately, the Planning & Zoning Commission made a motion to recommend denial of the PD-30 amendments. The motion to deny passed by a vote of 5-1. A Public Hearing on this matter is scheduled for the February 3, 2014 Town Council agenda.


January 10, 2014 --- The property owner of the 26-acre tract of land located at SH 114 and Trophy Club Drive (where the clock tower sits) has submitted proposed amendments to the existing Planned Development No. 30 (PD-30) Development Standards. As with any request, the Town is obligated to hear the proposal and follow proper procedures in the evaluation and consideration of the requested changes. The Planning & Zoning Commission will hold a Public Hearing for the proposed amendments to PD-30 on Thursday, January 16, 2014 at 7:00 in the Svore Municipal Building Boardroom (100 Municipal Drive) and the public is encouraged to attend and provide input.

In general, the proposed amendments are:

  1. Allow 30 townhouse/townhomes as a permitted use in Area I of Preliminary Site Plan; 3-story (50-ft. maximum height) building
  2. Increase maximum number of urban residential units from 250 units to 350 units;
  3. Permit urban residential units on the first floor of Buildings B4, B5, and B7, as shown on the Preliminary Site Plan, provided the first floors are “retail ready” allowing these floors to be converted to retail uses;
  4. Permit municipal facilities to be located within the property fronting on Indian Creek Drive;
  5. Changes to other sections of PD-30 necessitated by, associated with, or resulting from the requested amendments.

PD-30 Background

In January 2012, the Trophy Club Town Council rezoned a 26 acre tract for a Mixed-Use Planned Development (PD-30) located at Trophy Club Drive and Highway 114. The Town Council negotiated the development standards with the property owner over the course of several months and Trophy Club Town Center Development Standards was approved on January 27, 2012.
