COMPLIANCE DISMISSALS

DEFECTIVE REQUIRED EQUIPMENT OR IN UNSAFE CONDITION VIOLATIONS

  • These violations MAY be dismissed for a $10 FEE if the Defendant remedies the defect BEFORE the Defendant's first court appearance.
  • Special dismissal provision DOES NOT APPLY if the equipment involves a commercial motor vehicle.
  • If the remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.
  • The defendant must appear in PERSON or BY MAIL and submit a Compliance Dismissal Affidavit Form*.

The following is a list of equipment violations that are eligible for dismissal:

  • DEFECTIVE STOP LAMPS
  • DEFECTIVE TAIL LAMPS
  • DEFECTIVE TIRES
  • MIRROR VIOLATION
  • MUFFLER REQUIRED
  • NO LICENSE PLATE LAMP ON MOTORCYCLE
  • NO OR DEFECTIVE BRAKES
  • NO OR DEFECTIVE HEADLIGHTS
  • NO OR DEFECTIVE LICENSE PLATE LIGHTS
  • NO PARKING LAMPS
  • NO STOP LAMP ON MOTORCYCLE
  • NO STOP LAMPS
  • NO TAIL LAMPS
  • NO TAIL LAMPS ON MOTORCYCLE
  • OBSTRUCTED VIEW THROUGH WINDSHIELD OR WINDOW

DRIVER'S LICENSE VIOLATIONS

NO DRIVER'S LICENSE/UNLICENSED:

  • The Defendant must appear in Court BEFORE or ON the appearance date and/or pay the fine amount.
  • This violation has no special dismissal provisions.

VALID DRIVER'S LICENSE, BUT FAILED TO DISPLAY:

  • This violation MAY be dismissed for a $10 FEE if the Defendant produces proof of a driver's license to the Court BEFORE or ON the Defendant's first Court appearance.
  • Proof of insurance MUST have been valid at the time of the offense.

EXPIRED DRIVER'S LICENSE:

  • This violation MAY be dismissed for a $20 FEE if the Defendant remedies the defect within TWENTY (20) BUSINESS days after the offense or before the Defendant's first Court appearance, whichever is later, and produces proof of a driver's license, which is now current, to the Court.
  • If remedy is not completed or produced within this time frame, this violation is no longer available for a special dismissal provision.

DRIVER'S LICENSE RESTRICTION OR ENDORSEMENT:

  • This violation MAY be dismissed for a $10 FEE if the endorsement was imposed because of a physical condition that was surgically or otherwise medically corrected BEFORE the date of the offense, or in error and that is established by the Defendant; and
  • The Department of Public Safety (DPS) removes the restriction or endorsement BEFORE the Defendant's first Court appearance.

FAILURE TO REPORT CHANGE OF ADDRESS OR NAME:

  • This violation MAY be dismissed for a $20 FEE if the Defendant remedies the defect within TWENTY (20) BUSINESS days after the date of the offense and produces proof of the change to the Court.
  • If remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.

INSPECTION VIOLATIONS

NO INSPECTION:

  • The Defendant must appear in Court BEFORE or ON the appearance date and/or pay the fine amount.
  • This violation has no special dismissal provisions.

VALID INSPECTION, BUT FAILED TO DISPLAY:

  • This violation MAY be dismissed for NO FEE if the Defendant produces proof of inspection to the Court BEFORE or ON the appearance date.
  • Proof of inspection MUST have been valid at the time of the offense.

EXPIRED INSPECTION (less than 60 days):

  • This violation SHALL be dismissed for a $20 FEE if the Defendant remedies the defect within TWENTY (20) BUSINESS days after the offense or before the Defendant's first Court appearance, whichever is later, and produces proof of inspection, which is now current, to the Court.
  • If remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.

EXPIRED INSPECTION (more than 60 days):

  • This violation MAY be dismissed if the Defendant remedies the defect within TWENTY (20) BUSINESS days after the offense or before the Defendant's first Court appearance, whichever is later, and produces proof of inspection, which is now current, to the Court.
  • If remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.

REGISTRATION / LICENSE PLATE VIOLATIONS

NO REGISTRATION/UNREGISTERED:

  • The Defendant must appear in Court BEFORE or ON the appearance date and/or pay the fine amount.
  • This violation has no special dismissal provisions.

MOTOR VEHICLE IS REGISTERED, BUT OPERATED WITHOUT REGISTRATION OR WITH NO OR ONE (1) LICENSE PLATE:

  • This violation MAY be dismissed for a $10 FEE if the Defendant remedies the defect BEFORE the Defendant's first court appearance.
  • Registration for the vehicle MUST be current during the period the offense was committed, and the registration insignia must be attached to the car BEFORE the Defendant's first Court appearance.
  • If remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.
  • The defendant must appear in PERSON or BY MAIL and submit a Compliance Dismissal Affidavit Form*.

DISPLAYING ALTERED, UNCLEAN, OR OBSCURED LICENSE PLATE:

  • This violation MAY be dismissed for a $10 FEE if the Defendant remedies the defect BEFORE the Defendant's first court appearance.
  • If the remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.
  • The defendant must appear in PERSON or BY MAIL and submit a Compliance Dismissal Affidavit Form*.

EXPIRED REGISTRATION:

  • This violation MAY be dismissed for a $20 FEE if the Defendant remedies the defect within TWENTY (20) BUSINESS days after the offense or before the Defendant's first court appearance, whichever is later, and produces proof of registration, which is now current, to the Court.
  • The Defendant must also show proof of payment of late registration fee to the county tax assessor-collector.
  • If remedy is not completed or produced within this timeframe, this violation is no longer available for a special dismissal provision.
