ARREST
If
a Defendant is arrested on a Town of Trophy Club Class C Misdemeanor
warrant, he has the option to either pay the fine, post a
bond, or request credit for time served in jail.
Post
Bond
- The
Judge will accept the following types of bonds in order
to be released from jail:

Cash Bond:
A cash bond is usually for the amount equal to the fine.
The Defendant will receive a receipt for payment, and
a copy of the bond, which will indicate appearance instructions.
Should the Defendant fail to appear as instructed on
the bond, a plea of "Nolo Contendere" or "No Contest"
will be entered with the Court, and the bond funds will
be applied to the fine.
- Surety
Bond:
A local bondsman or an attorney usually provides this
bond. Upon payment of sum set by the surety, the Defendant
and Court will receive a copy of the bond and appearance
instructions.
- Personal
Bond:
The Judge may authorize the release of a Defendant from
jail on a "Personal Recognizance Bond" based on the
nature and circumstance of the offense charged, employment,
financial resources, character, mental condition, record
of convictions, etc. A release on recognizance is a
condition under which the Defendant is released in lieu
of bail, upon his promise to appear and respond to a
criminal charge against him. Upon release on a personal
bond, the Defendant and the Court will receive a copy
of the bond and appearance instructions.
In
cases where a bond is posted, please keep a copy of all documents.
The Defendant must appear in Court as instructed, normally
within ten (10) days. If the Defendant does not appear in
Court, a violation of "Failure to Appear"
may be filed and another warrant of arrest may be issued.
In this situation, the Defendant will be liable to pay any
additional fines. If unable to come to appear in Court as
instructed, the Defendant must complete an Appearance/Court
Date Reset Request*
in advance or come in person to request a new court date.
Please bring all paperwork related to the case.
Request
Credit For Time Served In Jail
The Judge may grant credit for time served in jail; however,
this must be formally requested. Furthermore, the Judge will
only grant credit for time served if the Defendant was incarcerated
on Town of Trophy Club charges. CREDIT WILL NOT BE EXTENDED
FOR TIME A DEFENDANT SPENDS IN JAIL ON UNRELATED CHARGES OR
BECAUSE HE WAS PLACED IN JAIL ON ANOTHER CITY'S CHARGES (I.E.,
KELLER, ROANOKE, WESTLAKE, DENTON COUNTY, ETC.).
Normally,
this request can be made at the jail during the Defendant's
incarceration. The jail will forward all necessary paperwork
to the Court for approval. Should the Defendant want to request
credit for time served after he has been released from jail
on a promise to appear, this can be accomplished with the
Court during the timeframe that is specified on the bond.
The Defendant must submit in writing the following to the
Court: Name, date of birth, violation number, date of incarceration,
expected release date, and a plea of either "No Contest" or
"Guilty." A formal written request can also be submitted on
the Time Served Request*.
